1. Acceptance of Terms
Welcome to Fierce Fabrications. By placing an order through our website, social media pages, email, or any other sales platform, you acknowledge that you have read, understood, and agree to these Terms & Conditions. The Terms & Conditions in effect at the time your order is placed will apply to that order.
2. Our Products
Fierce Fabrications specializes in handcrafted and custom-made products. Because each item is individually created, slight variations in color, design placement, texture, engraving, stitching, or finish are normal and are not considered defects. These variations are part of the unique nature of handmade products.
Product photos are intended to represent our designs as accurately as possible. However, colors may appear differently depending on your device’s screen settings, lighting, and printing processes.
3. Stock Designs vs. Custom Orders
Stock Designs
Items featuring our original designs are sold as shown. Minor variations resulting from the handmade process are expected.
Custom & Personalized Orders
Customers are solely responsible for ensuring all submitted names, dates, photographs, logos, spellings, colors, and other personalization details are accurate.
Fierce Fabrications will reproduce the information exactly as submitted.
For select custom orders, a digital proof may be provided before production begins. Once a proof has been approved by the customer, no additional edits may be made, and Fierce Fabrications is not responsible for errors approved during the proofing process.
We reserve the right to refuse any custom order containing copyrighted material, trademarks, offensive language, hate speech, or content we believe is inappropriate or unlawful.
4. Pricing & Payment
All prices are listed in U.S. Dollars (USD) and are subject to change without notice.
Payment in full is required before production begins unless otherwise agreed upon in writing.
For large custom or bulk orders, a non-refundable deposit of 50% may be required before work begins. The remaining balance must be paid before shipment or pickup.
Failure to complete payment may result in order cancellation without refund of the deposit.
5. Order Changes & Cancellations
Stock orders may be canceled prior to shipment.
Custom and personalized orders may only be canceled before production begins.
Once production has started, no cancellations, design changes, personalization changes, or refunds will be accepted.
6. Production & Processing Times
Estimated production times are as follows:
· Stock items: 2–5 business days
· Custom and personalized items: 7–14 business days
· Large or bulk orders: Timeframes will be provided at the time of purchase.
Production estimates do not include shipping time.
During holidays, periods of high order volume, equipment maintenance, severe weather, supplier delays, or other unforeseen circumstances, processing times may be extended. Customers will be notified whenever possible.
7. Shipping
Orders are shipped using reputable shipping carriers with tracking information provided when available.
Once an order has been transferred to the shipping carrier, delivery times are outside the control of Fierce Fabrications.
We are not responsible for carrier delays, weather-related delays, customs delays, or packages marked as delivered by the shipping carrier.
Customers are responsible for providing a complete and accurate shipping address. Orders returned because of an incorrect address supplied by the customer may require additional shipping fees before reshipment.
If a package appears to be lost or damaged during transit, customers should contact the shipping carrier promptly. Fierce Fabrications will gladly assist by providing tracking information or other documentation needed to support a claim.
8. Returns, Refunds & Exchanges
Custom & Personalized Products
Due to the personalized nature of our products, all custom sales are final.
No refunds, returns, exchanges, or cancellations will be accepted unless the error was made by Fierce Fabrications.
Stock Products
Unused stock items may be returned within 14 days of delivery.
Returned items must be in their original condition and packaging.
Return shipping costs are the responsibility of the customer unless the return is due to our error.
9. Damaged or Incorrect Orders
If your order arrives damaged or incorrect, please contact us within 48 hours of delivery.
Please include:
· Your order number
· Clear photographs of the product
· Photographs of the shipping box and packaging
· A brief description of the issue
After review, Fierce Fabrications will determine whether the item qualifies for repair, replacement, store credit, or another appropriate resolution.
10. Product Care
To maximize the life of your handcrafted products:
Tumblers
· Hand wash only
· Do not place in the dishwasher
· Do not microwave
· Avoid prolonged exposure to extreme heat
· Do not soak
Improper care may permanently damage the finish or design.
General Products
Journals, keychains, canvas bags, bookmarks, gift sets, license plate covers, and other handcrafted items will naturally show signs of normal use over time.
Fierce Fabrications is not responsible for damage caused by misuse, accidents, improper storage, weather exposure, or normal wear and tear.
11. Intellectual Property
All original artwork, product designs, graphics, logos, product photography, branding, and written content created by Fierce Fabrications remain the exclusive property of Fierce Fabrications.
No content may be copied, reproduced, altered, resold, distributed, or used commercially without written permission.
Customers retain ownership of any photographs, logos, or artwork they submit for personalization.
By submitting content, customers represent and warrant that they own the rights to use the material or have obtained all necessary permissions.
Customers agree to indemnify and hold Fierce Fabrications harmless from any claims involving copyright, trademark, or intellectual property infringement related to submitted materials.
12. Privacy
Customer information is collected solely for order processing, payment, shipping, and customer service.
Fierce Fabrications does not sell, rent, or knowingly share customer information with third parties except when necessary to complete your order, process payment, or comply with applicable law.
13. Limitation of Liability
Fierce Fabrications shall not be liable for any indirect, incidental, consequential, or special damages arising from the purchase, ownership, use, or misuse of any product.
Our maximum liability shall never exceed the amount paid for the product purchased.
14. Force Majeure
Fierce Fabrications shall not be responsible for delays or failure to fulfill orders caused by events beyond our reasonable control, including but not limited to severe weather, natural disasters, power outages, supply shortages, labor disputes, shipping interruptions, governmental actions, or other unforeseen circumstances.
15. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
